Terms
Real Estate Media Service Agreement & Terms of Booking
This agreement governs all services provided by 8K Real Estate Media LLC to the Client for the ordered listing.
By scheduling, booking, or purchasing services from 8K Real Estate Media LLC, the Client agrees to all terms outlined in this agreement.
1. Acceptance of Terms
Booking services with 8K Real Estate Media LLC constitutes full acceptance of this agreement and all terms contained herein.
If the Client does not agree to these terms, services should not be booked.
2. Ownership of Media
All photographs, videos, drone imagery, and media produced by 8K Real Estate Media LLC remain the exclusive intellectual property of 8K Real Estate Media LLC under U.S. Copyright Law (17 U.S.C. �??????�?????�????�???�??�?�§101 et seq.).
The Client is not purchasing ownership of the media, but rather a limited license to use the media.
3. License for Use
Upon payment and delivery of media, the Client is granted a limited, non-exclusive, non-transferable license to use the media solely for marketing the ordered listing.
Permitted uses include:
MLS listings Real estate marketing Social media promotion Real estate websites Print marketing related to the listing Agent marketing associated with the listing
Media may not be resold, licensed, transferred, or distributed to third parties without written permission from 8K Real Estate Media LLC.
Unless otherwise agreed in writing, the license applies only while the property is actively being marketed.
4. Creative Style & Artistic Judgment
Photography and media production are creative services.
By booking services, the Client acknowledges familiarity with the portfolio and agrees that composition, camera angles, lighting, editing style, color grading, and artistic interpretation are determined according to the professional and artistic judgment of 8K Real Estate Media LLC.
Creative preference or stylistic disagreement does not constitute failure to perform services.
5. Subjective Satisfaction Clause
Photography and media production involve artistic interpretation.
Dissatisfaction based on personal taste, stylistic preference, homeowner opinion, seller feedback, or marketing opinions does not constitute grounds for refunds, service disputes, or liability.
6. Third-Party Opinion Clause
Feedback or opinions from third parties including homeowners, sellers, brokers, agents, marketing professionals, or outside reviewers shall not constitute grounds for refund, service dispute, or liability against 8K Real Estate Media LLC.
7. Property Preparation
The Client is responsible for ensuring the property is clean, staged, decluttered, and photo-ready prior to the scheduled shoot.
8K Real Estate Media LLC and its photographers are not responsible for cleaning, staging, moving furniture, removing clutter, or organizing the property.
If the property is not photo-ready at the scheduled time, results may be affected.
8. Property Condition Acknowledgment
The Client acknowledges that the final quality of images is dependent on the condition of the property at the time of the shoot.
8K Real Estate Media LLC is not responsible for visual elements present at the property including clutter, damage, staging, lighting conditions, or property layout.
9. Scheduling & Property Access
The Client is responsible for ensuring full access to the property at the scheduled time.
Delays caused by lack of access, occupants, pets, or unprepared property conditions may result in shortened shoot time or additional rescheduling fees.
10. Weather & Environmental Conditions
Weather conditions, lighting conditions, property orientation, surrounding buildings, and time of day may affect photographic results.
These environmental conditions are outside the control of 8K Real Estate Media LLC.
Exterior photography, drone photography, or twilight photography may be adjusted, rescheduled, or substituted based on weather or safety conditions.
11. Drone Operations
Drone photography is subject to FAA regulations, weather conditions, and restricted airspace.
If drone operation is restricted or unsafe, 8K Real Estate Media LLC may substitute alternate photography methods.
12. Service Completion
Services are considered rendered once the photography session has been completed.
Media delivery constitutes completion of the service.
13. Refund Policy
Due to the time, labor, travel, and post-production involved in photography services, refunds are not guaranteed once a shoot has been completed.
If the Client has concerns regarding the delivered media, 8K Real Estate Media LLC may offer corrective measures at its discretion. These may include minor editing revisions, re-editing of select images, reshooting the property at the discretion of 8K Real Estate Media LLC, or a credit toward a future service.
Any refunds, if issued, are solely at the discretion of 8K Real Estate Media LLC.
14. Revision Policy
Minor editing revisions may be requested within 3 business days of media delivery.
Requests beyond basic corrections may incur additional fees.
15. Cancellation & Rescheduling
Appointments canceled within 24 hours of the scheduled shoot may be subject to cancellation fees.
Rescheduling may be allowed based on availability.
16. Payment Obligation
The Client agrees that payment for services remains due regardless of whether the delivered media is used.
Delivery of media does not waive the Client�?????�????�???�??�?�¢??s obligation to pay for services rendered.
Failure to pay an invoice does not grant the Client any rights to use the media.
Any use of the media prior to payment being received constitutes unauthorized use and a violation of U.S. copyright law.
17. Limitation of Liability
The total liability of 8K Real Estate Media LLC for any claim related to services shall not exceed the total amount paid by the Client for the service.
18. Consequential Damages Waiver
Under no circumstances shall 8K Real Estate Media LLC be liable for loss of listing, loss of business opportunity, marketing performance of the property, homeowner dissatisfaction, third-party opinions, lost profits, or speculative damages.
19. Indemnification
The Client agrees to indemnify and hold harmless 8K Real Estate Media LLC from any claims, damages, legal disputes, or liabilities arising from the use of the media.
20. Chargebacks & Payment Disputes
The Client agrees not to initiate a chargeback or payment dispute after services have been completed and media delivered.
Any disputes must first be addressed directly with 8K Real Estate Media LLC.
21. Governing Law
This agreement shall be governed by the laws of the Commonwealth of Virginia.
22. Agreement
By booking services with 8K Real Estate Media LLC, the Client confirms they have read, understood, and agreed to all terms contained in this agreement.
